ORDINANCE OF THE COUNCIL OF THE CITY OF REDWOOD CITY ESTABLISHING A DOWNTOWN BUSINESS IMPROVEMENT AREA AND ITS BENEFIT ZONES IN A PORTION OF THE CITY OF REDWOOD CITY IN ACCORDANCE WITH SECTION 36500 ET SEQ. OF THE STREETS AND HIGHWAY CODE; DESCRIBING THE BOUNDARIES OF THE PROPOSED AREA; STATING THE USES TO WHICH THE REVENUES FROM THE ASSESSMENTS WILL BE PUT; DESCRIBING THE METHOD AND BASIS OF LEVYING THE ASSESSMENT; AND MAKING A DETERMINATION REGARDING PROTESTS

<br /> DAL:dft ?/05/9l (003/10) <br /> DES:dft /11/91R <br /> SECTION 5. The name of the Area shall be "Downtown Business <br />Improvement Area No. 2". <br /> SECTION 6. The improvements and/or act.ivities to be funded <br />by the levy upon businesses in the aforesaid Area are set forth in <br />Exhibit B, attached hereto, incorporated by reference as t.hough <br />set forth in full. <br /> SECTION 7. Except where funds are otherwise available, an <br />assessment shall be levied annually to pay for the improvements <br />and/or activities within the Area. Revenue from the levy of <br />assessment shall not be used to provide improvements or activities <br />outside the Area. <br /> SECTION 8. The method and basis of levying the assessment <br />for each business owner shall be as set fort.h in Exhibit C <br />attached hereto, incorporat.ed by reference herein as though set <br />forth in full. The initial levy of the assessment shall begin on <br />or about July 1, 1991. <br /> SECTION 9. New businesses in the Area shall not be exempt <br />from the levy of the assessment. <br /> SECTION 10. At the public hearing, the City Council heard <br />and considered all protests against the establishment of the Area, <br />the extent of the Area, the method and basis of levying <br />assessments, or the furnishing of specified types of improvements <br />or activities within the Area filed pursuant to Resolution No. <br />11478. <br /> SECTION 11. This Council hereby finds that there were 2 <br />written and 2 oral protests from owners of businesses in the Area, <br />including protests withdrawn, representing one (1) percent of the <br /> 3 2036 <br />- <br />
