DES:dft /21/95 (007/12) <br /> <br /> WHEREAS, on October 4, 1994 the Planning Commission <br />certified that the draft SEIR together with the Technical <br />Addendum had been completed in compliance with CEQA and, <br />together, constituted the final SEIR for the Project (the <br />"FSEIR"); and <br /> <br /> WHEREAS, a specific plan has been prepared for the Project <br />entitled, "Westport Specific Plan, December 9, 1994", (the "1994 <br />Specific Plan") and in conjunction therewith, a revised <br />development agreement (the "1995 Development Agreement") has been <br />prepared; and <br /> <br /> WHEREAS, the Planning Commission, after public hearing duly <br />noticed and held, has recommended that this Council adopt the <br />1994 Specific Plan and approve the 1995 Development Agreement; <br />and <br /> <br /> WHEREAS, this Council, after public hearing duly noticed and <br /> <br />held, approved the 1994 Specific Plan pursuant to Res. No. <br />~ ~ ~ , adopted February 27, 1995; and <br /> <br /> WHEREAS, implementation of the 1994 Specific Plan requires, <br />in part, the execution of the 1995 Development Agreement which <br />shall supersede and replace the 1985 Development Agreement; and <br /> <br /> WHEREAS, after public hearing duly noticed and held, and in <br />consideration of the recommendation of the Planning Commission, <br />of evidence both oral and documentary presented at said public <br />hearing, the 1988 FEIR and the FSEIR, and in further <br />consideration of the entire administrative record regarding <br />development of the Property, this Council desires to approve and <br />authorize execution of the 1995 Development Agreement; <br /> <br /> 4 <br /> <br /> <br />
