ORDINANCE AMENDING THE TIME BY WHICH POLES AND OVERHEAD WIRES SHALL BE REMOVED AND UNDERGROUND SERVICE PROVIDED WITHIN UNDERGROUND UTILITY DISTRICT IN A PORTION OF THE CITY OF REDWOOD CITY; AND ESTABLISHING THE USE OF UNDERGROUND CONVERSION ALLOCATION PURSUANT TO DECISION BY THE PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA

NOW, THEREFORE: <br /> <br /> The Council of the City of Redwood City does ordain as follows: <br /> <br /> Section 1. The foregoing recitals are, and each of them is, true and <br />correct and the Council so determines. <br /> <br />Section 2. Section 5 of Ordinance No. 2099 is hereby amended to read: <br />"Section 5. Pursuant to Section 11.45(c) of the Code of the City of <br />Redwood City, the date by which the undergrounding of all overhead utilities, <br />including existing service drops, and the removal of all wood utility poles, <br />overhead wires, and associated structures from all streets, roads, alleys, or ways <br />shall occur within said district is hereby extended from April 1, 1996, to <br />September 1, 1996. In the event that any act required by this article or by an <br />ordinance adopted pursuant to Ordinance No. 2099, as amended by this <br />Ordinance, cannot be performed within the time provided on account of shortage <br />of materials, war, restraint by public authorities, strikes, labor disturbances, civil <br />disobedience, or any other circumstances beyond the control of the actor, then <br />the time within which such act will be accomplished shall be extended for a <br />period equivalent to the time of such limitation." <br /> <br />Section 3. Section 2.A. is added to Ordinance 2099 as follows: <br />"Section 2.A. The utility company which undertakes underground <br />installation of its facilities shall use the underground conversion allocation <br />computed pursuant to decision of the Public Utilities Commission of the State of <br />California for the purpose of providing to each premises in the Underground <br /> <br /> Ord-O02 3 <br /> FXS:rg <br /> 02/05/96 <br /> <br /> <br />
