that the Permittee's or owner's address is unknown, the Building Inspector may, within <br />ten (10) days of the posting of the Notice on the Newsrack, deem the Newsrack <br />abandoned. The Notice shall: (1) state the nature of the violation; (2) state the date of <br />posting of the Newsrack or Newsracks so found in violation; (3) require the correction <br />of the violations within ten (10) days from the date of the Notice; and (4) provide <br />notification that any person notified under this section may submit, within ten (10) days <br />of the date of the Notice, a wdtten request for a hearing (the "Hearing") before the <br />Building Inspector. The Headng shall be held within a reasonable time but not less <br />than five (5) days after the request for a Hearing was received by the Building <br />Inspector. In the event the Permittee or owner to whom Notice is sent: (1) fails to <br />correct the violation or violations within ten (10) days from the date of the Notice or <br />fails to request a Hearing; or (2) the Building Inspector determines at the Hearing that <br />a violation of this Chapter has occurred and thereafter the violation has not been <br />corrected within seven (7) days from the date of the Hearing, the Newsrack or <br />Newsracks so found in violation of any of the aforesaid provisions shall be deemed <br />abandoned. In the event of such abandonment, the Building Inspector may cause the <br />removal and destruction or other disposition thereof. The Newsracks shall be retained <br />by the City and may be recovered by the Permittee or owner for thirty (30) days <br />following removal. Newsracks which are not claimed and recovered within thirty (30) <br />days from the date of removal shall be deemed permanently abandoned and shall be <br />disposed of by the City. The Permittee, owner, or person responsible for such <br />Newsrack shall pay upon demand an impound fee covering the actual cost to the City <br />of the removal, transportation, storage, and disposition of such Newsrack. <br /> <br />7/2/97 1 4 <br />7/9/97R <br />7/16/97R <br /> <br /> <br />
