Notwithstanding any provision set forth herein, prior notice of removal of a <br />Newsrack is not required (1) in the event of an emergency or (2) when a Newsrack <br />poses a danger to pedestrians or vehicles, provided a reasonable attempt to provide <br />notice of the removal of a Newsrack to Permittee or owner, and an opportunity to be <br />heard is given prior to the removal of the Newsrack. <br />43.15 Appeals <br /> <br /> The Permittee, or Applicant for a Permit hereunder, or any owner of a <br />Newsrack or Newsracks for which no Permit has been issued or for which no <br />Application has been made, maY appeal any decision or determination of the Building <br />Inspector to the Director by filing written notice of such appeal with the City Clerk within <br />seven (7) days of an adverse decision or determination by the Building Inspector. Any <br />decision made by the Director may be appealed to the City Manager by filing wdtten <br />notice of such appeal with the City Clerk within seven (7) days of such decision or <br />determination. The City Manager's decision shall be final. <br />43.16 Impounded Funds <br /> <br /> All money contained or placed in any Newsrack destroyed or otherwise <br />disposed of pursuant to the provisions of this Chapter, shall be retained by the City for <br />a period of one year and disposed of pursuant to previsions of law governing found or <br />abandoned property. <br /> <br />43.t7 Summary_ Corrections <br /> <br /> In the case of violations of the provisions of this Chapter relating to: (1) the <br />attachment of Newsracks to property other than that owned by the Permittee or <br />pursuant to the permission of the owner of such property; (2) the attachment to fixed <br />objects or to each other; or (3) the location of Newsracks, the Building Inspector may, <br /> <br />7/2/97 1 5 <br />7/9/97R <br />7/16/97R <br /> <br /> <br />
