"Permittee" means the person to whom a Permit for the placement, installation, <br />maintenance of a Newsrack on, within, or projecting into a Public Right-of-Way or <br />Public Property has been issued pursuant to this Chapter. <br /> <br /> "Person" means any human being or legal entity including but not limited to a <br />corporation, partnership, limited partnership, or unincorporated association. <br /> <br /> "Public Property" means property owned by the City in a proprietary interest <br />and open to members of the general public. <br /> <br /> "Public Right-of-Way" or "Public Rights-of-Way" means that area or those <br />areas dedicated to public use for public street purposes including, but not limited to, <br />roadways, parkways, alleys, and sidewalks. <br /> <br /> "Publication" means newspapers, periodicals, magazines or other pdnted <br />materials. <br /> <br /> "Roadway" means that portion of a Public Right-of-Way improved, designed, <br />and ordinarily used for vehicular traffic. <br /> <br /> "Sidewalk" means any area provided for the exclusive use of pedestrians, <br />including planting areas or parking stdps, between the public Roadway and adjacent <br />property line. <br /> <br />43.3 Permit Required <br /> <br /> No person shall place, install, maintain, or cause to be placed, installed, or <br /> <br />maintained a Newsrack on, within, or projecting into a Public Right-of-Way or Public <br />Property, without first secudng a Permit therefor from the Building Inspector. <br /> <br />43.4 Prohibited in Roadway <br /> <br /> NO person shall place, install or maintain any Newsrack which projects into, or <br /> <br />which rests, fully or in part, upon, along, or over any portion of a Roadway. <br /> <br />7/2/97 5 <br />7/9/97R <br />7/16/97R <br /> <br /> <br />
