- 0 R I G I N A L 11/22/99 <br /> ORDINANCE NO. 2183 <br /> <br /> ORDINANCE OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> APPROVING AND AUTHORIZING EXECUTION OF FRANCHISE <br /> AGREEMENT WITH BFI WASTE SYSTEMS OF NORTH AMERICA, <br /> INC., FOR SOLID WASTE, RECYCLABLE MATERIALS AND PLANT <br /> MATERIALS COLLECTION SERVICES <br /> <br /> WHEREAS, the City of Redwood City has heretofore entered into franchise <br />agreements with BFI Waste Systems of North America, Inc., or its predecessor in <br />interest (BFI), for the collection of solid waste, recyclable material and plant materials <br />as described in those agreements, including a Uniform Franchise Agreement dated <br />as of October 1, 1987, and as subsequently amended by first through fourth <br />amendments thereto; and <br /> <br /> WHEREAS, subject to the condition hereinafter stated, this Council proposes <br />to enter into a new agreement with BFI entitled "Agreement For Refuse, Recycling <br />and Plant Material Collection Services," (the Franchise Agreement); and <br /> <br /> WHEREAS, the Franchise Agreement contains terms and conditions for <br />evaluation of the performance of BFI, including rate comparability, customer <br />satisfaction, and implementation of new and expanded diversion programs; and <br /> <br /> WHEREAS, the term of the Franchise Agreement is for an initial period of <br />seven years from January 1, 2000 to December 31, 2006 and may only be extended <br />on condition of the City's affirmative evaluation of BFI's performance; and <br /> <br /> WHEREAS, the Franchise Agreement shall only go into effect and supemede <br />the City's existing Uniform Franchise Agreement and related recycling agreement and <br />solid waste agreement upon the condition that the South Bayside Waste <br />Management Authority (SBWMA), an entity created by joint exercise of powers <br />agreement pursuant to California Government Code §§ 6500 et. seq., successfully <br />acquires the San Carlos Transfer Station and San Mateo Recyclery properties owned <br /> <br />Ord-097 <br />DES:djk <br />F : SharedlRedwoodlCouncillOrd <br />11/03/99R <br />11/08/99R <br /> <br /> <br />
