by BFI, on or before April 1, 2000; and <br /> <br /> WHEREAS, this Council hereby determines that approval and execution of the <br />Franchise Agreement is in the best interest of the health, safety and welfare of the <br />City of Redwood City; <br /> <br /> NOW, THEREFORE; <br /> <br /> THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1. That certain Franchise Agreement entitled, "Franchise Agreement <br />Between the City of Redwood City and BFI Waste Systems of North America, Inc. for <br />Solid Waste, Recyclable Materials, and Plant Materials Collection Services", dated <br />September 9, 1999,a copy of which is on file in the office of the City Clerk, to which <br />copy reference is hereby made for the full particulars thereof, is hereby approved, <br />and the City Manager and City Clerk are hereby authorized and directed to execute, <br />and to attest thereto, respectively, said agreement for and on behalf of the City of <br />Redwood City. <br /> <br /> Section 2. This ordinance shall be effective thirty (30) days from the date of <br />its adoption; provided, however, that the agreement approved hereby shall be <br />effective and shall supercede the City's existing uniform franchise agreement and <br />related recycling agreement only in the event the South Bayside Waste Management <br />Authority ("SBWMA"), an entity created by joint exercise of powers agreement <br />pursuant to California Government Code Section 6500 et seq., successfully acquires <br />the San Carlos Transfer Station and San Mateo Recyclery properties owned by BFI, <br />on or before April 1, 2000. <br /> <br />Ord-097 2 <br />DES:djk 2 1 83 <br />F:Shared/Redwood/CouncillOrd <br />11/03/99R <br />11/08/99R <br /> <br /> <br />
