1816 MAR 10 1980 --------- - - ORDINANCE ADDING SECTION 19.8 TO CHAPTER 19 OF THE CODE OF THE CITY OF REDWOOD CITY, RELATIVE TO THE OFFERING FOR SALE OF DRUG PARAPHERNALIA TO MINORS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. This Council hereby finds that the open display of drug paraphernalia, especially in business establishments that otherwise cater to the desires of minor children, tends to encourage experimentation wi th and use of illegal drugs by such minor children in such a manner that the parents or guardians of such minor children cannot exercise meaningful parental responsibility or control. This Council further finds that such use, experimentation, and negative effect upon parental responsibility and control constitutes

This Council hereby finds that the open display of <br />drug paraphernalia, especially in business establishments that <br />otherwise cater to the desires of minor children, tends to encourage <br />experimentation wi th and use of illegal drugs by such minor children <br />in such a manner that the parents or guardians of such minor <br />children cannot exercise meaningful parental responsibility or control. <br />This Council further finds that such use, experimentation, and <br />negative effect upon parental responsibility and control constitutes <br />a nuisance hazardous to the health, safety and welfare of the community. <br />Therefore, this Council believes that, in order to promote and <br />assist meaningful parental responsibility and control, and to promote <br />and protect the health, safety and welfare of our minor children, <br />drug paraphernalia must not be displayed in any portion of a place <br />of business where a minor child is permitted without the presence <br />of his or her parent or legal guardian. <br />SECTION 2. Section 19.8 is hereby added to Chapter 19 of the <br />Code of the City of Redwood City, to read as follows: <br />"Section 19.8 Rooms in Which Drug Paraphernalia is <br />Offered for Sale. It is a public nuisance for any place of <br />business to which the public is invited, to exhibit, display <br />or offer for sale any device, contrivance, instrument or <br />paraphernalia designed, modified or altered for the purposes <br />of smoking, ingesting or consuming marijuana, hashish, PCP, <br />or any controlled substance as defined in the Health and Safety <br />Code of the State of California, Division 10, as said division <br />may from time to time be amended, supplemented, or replaced, <br /> 1 816 <br /> ~. <br />
