1816 MAR 10 1980 --------- - - ORDINANCE ADDING SECTION 19.8 TO CHAPTER 19 OF THE CODE OF THE CITY OF REDWOOD CITY, RELATIVE TO THE OFFERING FOR SALE OF DRUG PARAPHERNALIA TO MINORS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. This Council hereby finds that the open display of drug paraphernalia, especially in business establishments that otherwise cater to the desires of minor children, tends to encourage experimentation wi th and use of illegal drugs by such minor children in such a manner that the parents or guardians of such minor children cannot exercise meaningful parental responsibility or control. This Council further finds that such use, experimentation, and negative effect upon parental responsibility and control constitutes

<br />other than prescription drugs, unless so exhibited, displayed <br />or offered within a separated room or room-like enclosure from <br />which minors under the age of 18 years are excluded. Said <br />room shall be designed so that its contents are not visible to <br />persons outside it, and shall have posted at every entrance <br />thereto a sign stating in reasonably visible and legible words <br />that minors under the age of 18 years, unless accompanied by <br />their parent or legal guardian, shall not be admitted. <br /> "It is an act of public nuisance for any owner, manager, <br />proprietor or other person in charge of any place of business <br />to invite, allow or permit any minor under the age of 18 years <br />to enter, visit or remain in such a separate room as described <br />in this section, or in any other place where the paraphernalia <br />described in this section is exhibited unless such minor is <br />accompanied by his or her parent or legal guardian. <br /> "The provisions of this section shall be enforceable <br />pursuant to the provisions of Section 731, et seq., of the <br />Code of Civil Procedure of the State of California. This remedy <br />is in addition to any other remedy provided by law, including <br />the penalty provisions applicable for violation of the terms <br />and provisions of this Code." <br />SECTION 3. It is hereby declared to be the intention of this <br />Council that the sections, paragraphs, sentences, clauses, phrases <br />and words of this ordinance are severable, and, if for any reason <br />any section, paragraph, sentence, clause, phrase or word of this <br />ordinance shall be held invalid, such invalidity shall not affect <br />the validity of the remaining part of this ordinance. <br />SECTION 4. This ordinance shall be effective 30 days after <br />its adoption. <br /> * * * <br /> -2- <br /> -...' " <br />
