<br /> DCB:rks 6/19/84R <br /> DCB:sh 8/02/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br /> Gross annual revenues shall not include any taxes on the <br />services furnished by the Grantee imposed directly on any user or <br />subscriber by any city, state, federal, or other governmental <br />unit and collected by the Grantee for such governmental unit. <br /> Gross annual revenues shall not include revenue from <br />connection charges; provided, however, any portion of the <br />connection charges which is in effect an actual prepayment of <br />monthly service charges shall be included in gross annual <br />revenues. <br /> "Section 11.72. (a) A non-exclusive franchise to <br />construct, operate and maintain a CATV system within all or any <br />portion of the City may be granted by the City Council to any <br />person, firm or corporation, whether operating under an existing <br />franchise or not, who or which offers to furnish and provide <br />such system under and pursuant to the terms and provisions of <br />this article. No provision of this article shall require the <br />granting of a franchise when the council finds it is in the <br />public interest to restrict the number of Grantees to one or <br />more. Any franchise granted pursuant to this article shall <br />permit the Grantee to operate a CATV system in the City subject <br />to all local ordinances concerning the erection, installation, <br />construction, repairing, replacing, reconstructing, maintaining <br />and retaining in, on, over, under, upon, across and along any <br />public street or highway, poles, wires, cables, conductors, <br />ducts, conduits, vaults, manholes, amplifiers, attachments, and <br />other property as may be appurtenant to the CATV system.
