ODIGIJ'\I~L HIlly 1984 --------- AN ORDINANCE REPEALING ARTICLE III (COMMENCING WITH §11.70) OF, AND ADDING ARTICLE III (COMMENCING WITH §11.70) TO, CHAPTER 11 OF THE CODE OF THE CITY OF REDWOOD CITY RELATING TO COMMUNITY ANTENNA TELEVISION SYSTEN. REGULATIONS AND REPEALING ORDINANCE NO. 1891 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION l. Article III (commencing with §11.70) of Chapter 11 of the Code of the City of Redwood City is hereby repealed. SECTION 2. Article III (commencing with §ll.70) is hereby added to Chapter 11 of the Code of the City of Redwood City to read as follows

<br /> DCB:rks 6/19/84R <br /> DCB:sh 8/02/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br /> agreement between the City and the Grantee related to <br /> the CATV system; <br />(b) the Grantee's quality of service or response to <br /> subscriber complaints has demonstrated a continuing, <br /> willful pattern of inadequacy, which has not been <br /> corrected by the Grantee within thirty (30 ) day's after <br /> written notice to correct such conditions given by <br /> City; <br />(c) the Grantee has failed to provide or maintain in full <br /> force and effect the insurance and bond coverages, or <br /> comply with security fund or indemnification <br /> requirements as specified in the franchise; <br />(d) the Grantee has frequently violated any order or ruling <br /> of any regulatory body having jurisdiction over the <br /> Grantee relative to its franchise unless such order or <br /> ruling is being contested by the Grantee in a court of <br /> competent jurisdiction; <br />(e) the Grantee has attempted to evade any of the <br /> provisions of its franchise or this article or has <br /> practiced any fraud or deceit upon the City; <br />(f) the Grantee has became insolvent, unable or unwilling <br /> to pay its debts, or is adjudged a bankrupt. <br />"Section 11.74. Any Grantee granted a franchise under this <br />article shall pay to the City, during the life of such franchise, <br />and at the times hereinafter specified, not more than five (5 ) <br />per cent of the gross annual revenues derived from the use of the <br />franchise, which percentage shall be set forth in the ordinance <br />awarding the franchise, and such payment shall be in addition to <br />any occupation tax, license tax or similar levy or fee imposed by <br />the City. <br />"Section 11.75.
