ODIGIJ'\I~L HIlly 1984 --------- AN ORDINANCE REPEALING ARTICLE III (COMMENCING WITH §11.70) OF, AND ADDING ARTICLE III (COMMENCING WITH §11.70) TO, CHAPTER 11 OF THE CODE OF THE CITY OF REDWOOD CITY RELATING TO COMMUNITY ANTENNA TELEVISION SYSTEN. REGULATIONS AND REPEALING ORDINANCE NO. 1891 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION l. Article III (commencing with §11.70) of Chapter 11 of the Code of the City of Redwood City is hereby repealed. SECTION 2. Article III (commencing with §ll.70) is hereby added to Chapter 11 of the Code of the City of Redwood City to read as follows

<br /> DCB:rks 6/19/84R <br /> DCB: sh 8/02/84R <br /> DES:sh lO/25/84R <br /> DES:sh 11/26/84R <br /> " (a) Franchises granted under this article shall be <br />nonexclusive. <br />" (b) No privilege or exemption shall be granted or conferred <br />under this article except those specifically prescribed herein. <br /> " (c) Any privilege claimed by the Grantee in any street, or <br />other public property, or easement, shall be subordinate to any <br />prior lawful occupancy of such street, property, or easement. <br /> " (d) No franchise shall be sold, transferred, leased, <br />assigned or disposed of, in whole or in part, either by force of <br />involuntary sale, or by voluntary sale, merger, consolidation or <br />otherwise, other than to an entity in which a Grantee or an <br />affiliate of a Grantee has at least a fifty (50%) percent equity <br />and voting interest therein, without the prior consent of the <br />City Council evidenced by resolution. Such duly adopted consent <br />shall not unreasonably be withheld; provided, however, that the <br />prospective assignee must agree in writing to comply with all <br />provisions of this Ordinance. Notwithstanding anything to the <br />contrary set forth in this Section 11.75(d), no such consent <br />shall be required for a transfer in trust, by mortgage, or by <br />other hypothecation, in whole or in part, or to assign rights in <br />the CATV system to secure indebtedness. <br /> " (e) The Grantee shall have no recourse whatsoever against <br />the City for any loss, cost, expense, or damage, arising out of <br />lawful enforcement of any provisions or requirements of this <br />article or its enforcement. <br /> 6 <br /> '-~"'- <br />
