DES:sh 11/26/84R OR;/ '"'fill 1906 I GuĂș1L ORDINANCE 1 7 7984 --------- AN ORDINANCE AWARDING A NON-EXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE AND MAINTAIN A COMMUNITY ANTENNA TELEVISION SYSTEM WITHIN THE CITY OF REDWOOD CITY TO NATIONWIDE CABLEVISION, INC., DBA PENINSULA CABLE TV; ESTABLISHING CERTAIN CONDITIONS THEREFOR; AND REPEALING ORDINANCE NO. 1892 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. REPEALER. Ordinance No. 1892, adopted April 2, 1984 entitled "An Ordinance Awarding Non-Exclusive Franchise to Construct, Operate and Maintain a Community Antenna Television System Within the City of Redwood City to Nationwide Cablevision

<br />DCB:rks 6/28/84R <br />DCB:sh 8/06/84R <br />DCB:sh 8/17/84R <br />DES:sh 10/25/84R <br />DES:sh 11/26/84R <br /> <br /> <br />following written notice from Grantor, to comply with any other <br /> <br />material provision of this franchise which Grantor reasonably <br /> <br />determines can be remedied by an expenditure of the security, <br /> <br />Grantor may withdraw an amount sufficient to compensate for such <br /> <br />payment or expenditure, plus interest and any penalties, from the <br /> <br />security fund. Upon such withdrawal, Grantor shall notify <br /> <br />Grantee of the amount and date thereof. <br /> <br />(4) The security deposited pursuant to this <br /> <br />subdivision shall become the property of Grantor in the event <br /> <br />that this franchise is cancelled by reason of the default of <br /> <br />Grantee or revoked for cause in accordance with the procedures <br /> <br />hereof or under the CATV Ordinance. Grantee, however, shall be <br /> <br />entitled to the return of such security fund, or portion thereof, <br /> <br />as remains on deposit at the expiration of the term of this <br /> <br />franchise, or upon earlier termination hereof, provided that <br /> <br />Grantee is not then in default hereunder or under any provision <br /> <br />of the CATV Ordinance. <br /> <br />(c) Insurance. Grantee shall take out and maintain during <br /> <br />the term hereof the following types and amounts of insurance: <br /> <br />(1) Workers' Compensation Insurance: in such coverage <br />amounts as may be required by the Workers' <br />Compensation Insurance and Safety laws of the <br />State of California and any amendments thereto. <br /> <br />(2) Comprehensive General Liability: insuring against <br />all claims, losses, or damages for personal or <br />bodily injury, including loss of life, in the <br />amount of One Million Dollars ($1,000,000) for <br />each occurrence, and for property damage <br />constituting injury to or destruction of property, <br />including the loss of use thereof, in the amount <br /> <br /> <br /> <br />13 <br /> <br /> <br /> <br /> <br />_......... <br />
