REPEALER. Ordinance No. 1892, adopted April 2, 1984 entitled "An Ordinance Awarding Non-Exclusive Franchise to Construct, Operate and Maintain a Community Antenna Television System Within the City of Redwood City to Nationwide Cablevision

If Grantor makes a preliminary <br />determination that Grantee is in violation of any provision of <br />this franchise, the CATV Ordinance, any rule or regulation <br />promulgated pursuant to this franchise or said ordinance, or any <br />applicable federal, state, or local law, Grantor shall demand in <br />writing that Grantee correct or cure such violation. <br /> If the violation is not corrected or cured to the <br />satisfaction of Grantor within thirty (30) days following such <br />demand, Grantor shall make a final determination whether or not <br />such violation occurred or continues to exist and is or was <br />excusable or inexcusable, in accordance with the following <br />procedure: <br /> (a) Grantor shall notify Grantee in writing of the time, <br />date, and place of a public hearing to be held by Grantor's City <br />Council on the question of Grantee's alleged violation and <br />whether, if a violation is found, it is excusable or inexcusable. <br /> (b) If, upon the conclusion of the hearing Grantor's City <br />Council determines that such violation occurred or continues to <br />exist and is or was excusable, Grantor shall direct Grantee to <br />correct or cure said violation within such period of time, in <br />such manner and upon such terms and conditions as Grantor <br />reasonably may require, but without performance of any of the <br />remedies in Section 12 hereof provided. <br /> (c) If, upon conclusion of the hearing, Grantor's City <br />Council determines that such violation occurred or continues to <br /> 17 <br /> _. __..,.w <br />
