GRANTOR'S REMEDIES. If Grantor determines that <br />Grantee is in violation of any material term, condition, or <br />provision of this franchise, of the CATV Ordinance or any rule or <br />regulation promulgated pursuant to this franchise or said <br />Ordinance, or any applicable federal, state, or local law, <br />Grantor may order Grantee to: <br /> (a) Pay to Grantor liquidated damages of up to Five Hundred <br />Dollars ($500) per day for construction delays, and up to Two <br />Hundred Fifty Dollars ($250) per day for other material <br />violations (which amount shall depend upon the materiality of <br />such violation(s», which Grantee hereby agrees to pay. Grantor <br />and Grantee hereby agree that, from the nature of the case, it <br />would be impracticable or extremely difficult to fix the actual <br />damages sustained or to be sustained by Grantor by reason of any <br />of the aforesaid violations. Therefore, Grantor and Grantee <br />further agree that the foregoing amounts, or such lesser amount <br />as may be determined by Grantor, are liquidated damages and are <br />presumed to be the amount or amounts of damages so sustained by <br />Grantor. <br /> 18 <br /> _. --"-~""- <br />
