DES:sh 11/26/84R OR;/ '"'fill 1906 I GuĂș1L ORDINANCE 1 7 7984 --------- AN ORDINANCE AWARDING A NON-EXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE AND MAINTAIN A COMMUNITY ANTENNA TELEVISION SYSTEM WITHIN THE CITY OF REDWOOD CITY TO NATIONWIDE CABLEVISION, INC., DBA PENINSULA CABLE TV; ESTABLISHING CERTAIN CONDITIONS THEREFOR; AND REPEALING ORDINANCE NO. 1892 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. REPEALER. Ordinance No. 1892, adopted April 2, 1984 entitled "An Ordinance Awarding Non-Exclusive Franchise to Construct, Operate and Maintain a Community Antenna Television System Within the City of Redwood City to Nationwide Cablevision

<br /> DCB:rks 6/28/84R <br /> DCB:sh 8/06/84R <br /> DCB: sh 8/17/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br />exist and is or was inexcusable or not otherwise ameliorated by <br />extenuating circumstances, Grantor may, in addition, or as an <br />alternative to directing Grantee to correct or cure said <br />violation provided in (b) above, order compliance with one or <br />more of the remedies specified in Section 12. <br /> SECTION 12. GRANTOR'S REMEDIES. If Grantor determines that <br />Grantee is in violation of any material term, condition, or <br />provision of this franchise, of the CATV Ordinance or any rule or <br />regulation promulgated pursuant to this franchise or said <br />Ordinance, or any applicable federal, state, or local law, <br />Grantor may order Grantee to: <br /> (a) Pay to Grantor liquidated damages of up to Five Hundred <br />Dollars ($500) per day for construction delays, and up to Two <br />Hundred Fifty Dollars ($250) per day for other material <br />violations (which amount shall depend upon the materiality of <br />such violation(s», which Grantee hereby agrees to pay. Grantor <br />and Grantee hereby agree that, from the nature of the case, it <br />would be impracticable or extremely difficult to fix the actual <br />damages sustained or to be sustained by Grantor by reason of any <br />of the aforesaid violations. Therefore, Grantor and Grantee <br />further agree that the foregoing amounts, or such lesser amount <br />as may be determined by Grantor, are liquidated damages and are <br />presumed to be the amount or amounts of damages so sustained by <br />Grantor. <br /> 18 <br /> _. --"-~""- <br />
