DES:sh 11/26/84R OR;/ '"'fill 1906 I GuĂș1L ORDINANCE 1 7 7984 --------- AN ORDINANCE AWARDING A NON-EXCLUSIVE FRANCHISE TO CONSTRUCT, OPERATE AND MAINTAIN A COMMUNITY ANTENNA TELEVISION SYSTEM WITHIN THE CITY OF REDWOOD CITY TO NATIONWIDE CABLEVISION, INC., DBA PENINSULA CABLE TV; ESTABLISHING CERTAIN CONDITIONS THEREFOR; AND REPEALING ORDINANCE NO. 1892 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. REPEALER. Ordinance No. 1892, adopted April 2, 1984 entitled "An Ordinance Awarding Non-Exclusive Franchise to Construct, Operate and Maintain a Community Antenna Television System Within the City of Redwood City to Nationwide Cablevision

<br /> DCB:rks 6/28/84R <br /> DCB:sh 8/06/84R <br /> DCB:sh 8/17/84R <br /> DES:sh 10/25/84R <br /> DES:sh 11/26/84R <br />ordinances, rules, regulations and specifications of the City of <br />Redwood City heretofore or hereafter enacted or established. The <br />CATV System herein franchised shall be used and operated solely <br />and exclusively for the purpose herein expressly authorized and <br />no other purpose whatsoever <br /> Notwithstanding anything contained in this Section 2 to the <br />contrary, the City's rules, regulations, and specifications <br />hereafter enacted or established shall not unreasonably conflict <br />with the Grantee's material obligations or rights under the CATV <br />Ordinance or this franchise. <br /> SECTION 3. TERM. The term of the franchise granted herein <br />shall be 15 years commencing upon the operative date hereof, <br />subject to the terms and conditions hereof. <br /> Grantor and Grantee, in order to provide for technological, <br />economic, and regulatory changes in the state of the art of cable <br />communications, to facilitate renewal procedures, to promote the <br />maximum degree of flexibility in the CATV system, and to achieve <br />a continuing, advanced, modern system, shall comply with the <br />following system and services review provisions: <br /> (a) Grantor and Grantee shall conduct a System and Services <br />Review Session (as described and defined below) on or about the <br />fifth anniversary date of this franchise. A subsequent Review <br />Session shall be scheduled by Grantor five (5 ) years thereafter. <br />All such Review Sessions shall be open to the public, and notice <br /> 2 <br /> _. .~'~.^._- <br />
