If <br />such reconciliation statement shows that Grantor is entitled to a <br />greater amount in franchise fees than has already been paid by <br />Grantee to Grantor, Grantee shall pay such additional amount <br />within thirty (30) days of receipt of the reconciliation <br />statement. If such reconciliation statement shows Grantee has <br />paid a greater amount to Grantor than Grantor was entitled to <br />receive as a franchise fee, Grantor shall reimburse Grantee such <br />additional amount within thirty (30) days of receipt of the <br />reconciliation statement. <br /> No acceptance of any payment by Grantor shall be construed <br />as a release or as an accord and satisfaction of any claim <br />Grantor may have for further or additional sums payable as a <br />franchise fee under this ordinance or for the performance of any <br />other obligation of Grantee. <br /> In the event that any franchise payment or recomputed amount <br />is not made on or before the dates specified herein, Grantee <br />shall pay as additional compensation the greater of the following <br />amounts: <br /> (1 ) An interest charge, computed from such due date, <br /> at the annual rate equal to the prevailing <br /> commercial prime interest rate in effect upon the <br /> due date. <br /> ( 2) A sum of money equal to five percent (5%) of the <br /> amount due as liquidated damages to compensate <br /> Grantor for additional expenses and costs incurred <br /> by the reason of delinquent payment. <br /> SECTION 6.
