This Council hereby finds and recognizes that the FEIR cantains additions, clarifications, modif cations and other information in its responses to comments an the Draft ' Environmental Impact Re�ort fior ±he Project ("DEIR") and also incorporates inf�rm�ti�n obtained by the City since the DElR was issued. This Cauncil hereby finds and determines that such changes and additianal information are not significant new information as that term is defined under the provisions of the California Environmental Quality Act, because such changes and additianal infarmation do not indicate that any new significant environmental impacts not already evaluated would result from the Project and do not reflect any substantial increase in � the severity of any environmental impact; and that na feasible alternatives considerably different from those analyzed in the DEIR have been proposed that would lessen significant environmental impacts of the Project. Accordingly, this Council hereby finds and determines that recirculation of the FEIR for further public review and comment is nat warranted. 6. This Council hereby finds and recognizes tha# the Addendum ta the 2003 Environmenta( fmpact Report for the Marina Shores Village Project describes the changes and additians to the 2003 MSV EIR necessary ta achieve CEQA compliance for the currently praposed Peninsula Park project. This Council hereby finds and determines that, on the basis of substantial evidence in light of the whole record, such changes and additional information set forth in the Addendum are not significant new information as that terrn fs defined under the provisians of the Califomia Environmental Quality Act, because such changes and additional information do not indicate that any new significas�t envira�mental {mpacts not alseady evaluated would result fram the Peninsula Park Project and da not reflect any substanfial increase in the severity fl# any environmental impact; and that no feasible alternatives considerably difFerent from those analyzed En the DEIR have been proposed that would fessen significant enviranmen#al impacts of the Project. 7. This Council doss hereby designate the Planning Manager of the City af Redwaod City, at her office at 1017 Middlefield Road, P.O. Box 391, Redwood Ci#y, Caiifornia 94Q64-0391 as the custodian of documents and record of procesdings an which this decision is based; and 8. This Council does hereby make the foregoing findings with respect to the signifcant e�ects an the environment af the Peninsufa Park Project, as identified in the Addendum to the 2003 Environmental Impact Repart for the Marina Shores Village Project (Addendum), and further described and evaluated in the Final Envirortmen#al Impact Report (FEIR} for the Marina Shores Vilfage Project, with the stipulations that all information in these findings are in#ended as a summary o# the full administrative record supporting the Addendum and FEIR, which full administrative record shaufd be consulted for the full detaiEs supporting these findings, and that any mitigation measures and/or aliernatives that were suggested by cammenters to the Draft Environmentai Impact Report for the Marina Shores Village Project and were not adopted as part of the FEIR are hereby expressly rejected for the reasons stated in the FEIR and the responses to the comments set forth in the FEIR and elsewhere in the record. 9. Severabilitv. If any term, provision, or portion of these Findings or the applicatian of these Findings to a particular situation is held by a court#o be invalid, void or unenforceabfe, the remaining provisions of these Findings, ar their application to other actions related to the Peninsula Park Precise Plan Project, shall continue in ful[force and effect unless amended or modified by the City. 30.
