The Agency does not have the <br />authority to acquire property by eminent domain if the property is a conforming <br />residential property. For purposes of the Redevelopment Plan, a "conforming residential <br />property" shall mean a property which was zoned residential and in residential use <br />(owned or rented, single or multi-family) at the time the Redevelopment Plan was <br />amended in January, 1990. Pursuant to Amendment No.5 to the Redevelopment Plan, <br />adopted by Ordinance No. 2211, on July 9, 2001, the Agency's authority to acquire <br />property through eminent domain shall expire January 18, 2008.
