the Agency Parcel to the Project, all in accordance with the Disposition and Development Agreement for the Project; and WHEREAS, the Agency has made available copies of the Cinema DDA to members of the public for comment and held a duly noticed public hearing on the Cinema DDA in accordance with Section 33431 of the California Health and Safety Code; and WHEREAS, the Agency and the City have reviewed and considered the Cinema DDA, a copy of which is on file at the office of the Agency's Secretary at 1017 Middlefield Road, Redwood City, California, together with the Report of the staff to the Agency and the City on the DDA; NOW, THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL AND THE REDEVELOPMENT AGENCY OF THE CITY OF REDWOOD CITY, AS FOLOWS: 1. The City Council and the Agency, in their respective capacities of lead agency and responsible agency under CEQA, hereby certify that the Final EIR was presented to their members and that their members reviewed and considered the information contained in the Final EIR before approving the Cinema DDA. 2. The City Council and the Agency, in their respective capacities of responsible agency and lead agency under CEQA, hereby confirm the procedural record regarding CEQA review of the cinema - retail project, identify significant effects which can be mitigated to a less than significant level and significant effects which cannot be avoided, set forth the alternatives which have been examined as part of the CEQA review, adopt mitigation measures and a Mitigation Monitoring Program to be implemented for each mitigation measure, 5 RD -040 Concurrent Cinema Resolution: 1/24/01 14141
