Winslow Street would not be closed to through traffic; <br />WHEREAS, on October 17, 2000, the Planning Commission of the City of <br />Redwood City, following the provision of required notice, consideration of and <br />response to comments received (as set forth in greater detail in Attachment 1 <br />hereto) made certain findings required by CEQA and certified the Final EIR as <br />having been completed in compliance with CEQA; and <br />WHEREAS, on November 13, 2000, the City Council, after conducting a <br />duly noticed hearing, denied the appeal, filed on October 25, 2000, by Mr. Ted <br />Hannig, Hannig Law Firm, on behalf of Powerhouse Gym, of the Planning <br />Commission's decision to certify the FEIR and adopted finding in support of the <br />denial; and <br />WHEREAS, Agency, City and Developer have now completed, and <br />Developer has executed, the "Disposition and Development Agreement for <br />Downtown Retail - Cinema - Office and Parking Project" ( "Cinema DDA ") which <br />authorizes implementation of the Preferred Project, subject to the terms of the <br />Cinema DDA; and <br />WHEREAS, the Cinema DDA provides that in return for Developer's <br />performance the Agency shall attempt to acquire by negotiation or, if unable to <br />do so, shall consider acquiring by eminent domain certain parcels or portions <br />thereof located within the Project Site (the "Acquisition Parcels ") and, thereafter, <br />convey to Developer the Acquisition Parcels, an Agency owned parcel ( "Agency <br />Parcel ") and a City owned parcel (the "City Transfer Parcel "); and <br />WHEREAS, the City Council of the City of Redwood City, pursuant to <br />Section 33433 of the Health and Safety Code, has held a duly noticed public <br />hearing, made the requisite findings and approved the Agency's conveyance of <br />4 RD -040 <br />Concurrent Cinema Resolution: <br />1/24/01 <br />14141 <br />
