The decision of the Council on such <br /> appeal shall be final. <br /> Section 12.30. New Materials, Processes, Occupancies Requiring Permits. <br /> The City Manager, Fire Chief and the fire code official shall act as a <br /> committee to determine and specify, after giving affected persons an opportunity <br /> to be heard, any new materials, processes or occupancies, which shall require <br /> permits, in addition to those now enumerated in the Fire Code. <br /> Section 12.31. Violations; Penalties. <br /> A. Any person, firm, corporation or entity whether as principal, agent, employee <br /> or otherwise, who shall violate or cause the violation of any of the Fire Code <br /> adopted by Section 12.7 and as amended by this Article, or who shall fail to <br /> comply with any order, license, or permit made or issued thereunder, or who <br /> shall build any structure or improvement in violation of this Code or any <br /> detailed statement of specifications or plans submitted and approved <br /> thereunder, for each and every such violation and noncompliance, <br /> respectively, shall be guilty of an infraction and, shall be punishable by: <br /> 1. A fine not exceeding one hundred dollars ($100.00) for a first violation; <br /> and <br /> 2. A fine not exceeding five hundred dollars ($500.00) for a second violation <br /> of the same provision within one year from the date of the first violation; <br /> and <br /> 3. A fine not exceeding one thousand dollars ($1,000.00) for each additional <br /> violation of the same provision within one year from the date of the first <br /> violation. <br /> The imposition of any one penalty for any violation shall not excuse the <br /> violation or permit to continue. Each and every day a violation shall continue <br /> shall be deemed to be a separate violation. <br /> B. Use of the enforcement procedures of this section will be at the sole <br /> discretion of the Fire Chief, the fire code official, or their designees and will <br /> not limit or preclude the use of any other enforcement measures pursuant to <br /> this Code, State or Federal law. <br /> C. The Fire Chief or his authorized representatives shall enforce the provisions <br /> of the Fire Code adopted by Section 12.7 and as amended by this Article and <br /> all orders, licenses, certificates, permits and plans and specifications issued <br /> or approved thereunder and shall have the authority to issue citations for <br /> violations thereof." <br /> Atty/Ord/Ord.293 11 2326 <br /> 120407 FORMERLY MUFF#305 <br />
