12/16/2019 <br />WHEREAS, pursuant to Public Resources Code section 21081.6 and State CEQA <br />Guidelines section 15097, the City has prepared a program for reporting on or monitoring <br />the changes which it has either required in the Project or made a condition of approval to <br />mitigate or avoid significant environmental effects (the "Mitigation Monitoring and <br />Reporting Program" or "MMRP"), which is attached hereto as Exhibit "B"; and <br />WHEREAS, the EIR concluded that the Project would have a significant and <br />unavoidable impact on historical resources; and <br />WHEREAS, on July 2, 2019, the Planning Commission held a duly noticed public <br />hearing and received public testimony on the Draft EIR; and <br />WHEREAS, on July 11, 2019, the Historic Resources Advisory Committee held a <br />duly noticed public hearing and received public testimony on the Draft EIR. The City <br />received written and public testimony from the public during the Draft EIR public review <br />period; and <br />WHEREAS, all of the findings, recommendations and conclusions made by the <br />City Council pursuant to this Resolution are based upon the oral and written evidence <br />presented to it as a whole and not based solely on the information provided in this <br />Resolution; and <br />WHEREAS, prior to taking action, the City Council has heard, been presented with, <br />reviewed and considered all of the information and data in the administrative record, <br />including by not limited to the Draft EIR, all of which is incorporated herein by this <br />reference; and <br />WHEREAS, no significant new information has been added to the EIR after public <br />notice of the availability of the Draft EIR or added or modified in the Final EIR, under <br />CEQA Guidelines Section 15088.5. The additional information and modifications that <br />have been provided do not show (1) a new significant environmental impact, (2) a <br />substantial increase in the severity of an environmental impact, (3) that a feasible project <br />alternative or mitigation measure would clearly lessen the significant impacts of the <br />Project, but that the City declines to adopt it, or (4) that the Draft EIR was so fundamentally <br />and basically inadequate and conclusory in nature that meaningful public review and <br />comments are precluded. The EIR mitigation measures are incorporated into the Project <br />to avoid or substantially lessen significant environmental effects. Therefore, no further <br />analysis is required and there is no need to recirculate a revised EIR for further review <br />and comment; and <br />WHEREAS, the City prepared written responses to the comments received during <br />the comment period, which together with the Mitigation Monitoring and Reporting <br />Program ("MMRP") and the Draft EIR constitutes the Final EIR; and <br />ATTY/RE50.0124/CC RESO RECOMMENDING CEOA CERTIFICATION—YMCA RE50.
