12/16/2019 <br />WHEREAS, the Final EIR was published on October 11, 2019 more than 10 -days <br />before the Planning Commission and City Council hearings on the EIR; and <br />WHEREAS, on November 19, 2019, the Planning Commission held a duly noticed <br />public hearing and recommended certification of the Final EIR, adoption of the <br />environmental findings, a Mitigation Monitoring and Reporting Program and a State of <br />Overriding Considerations pursuant to the California Environmental Quality Act, as well <br />as issuance of the Project approvals; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY, AS FOLLOWS: <br />1. The above recitals are true and correct and together with the staff report <br />and the application materials, including, without limitation the Final EIR, and all other <br />documents, reports, studies, maps, oral and written testimony, and materials in the City's <br />file for the Project, all adopted City planning documents relating to the Project and the <br />Property including the City's General Plan, Zoning Ordinance, and other applicable City <br />laws and regulations, and all testimony and any submissions made to the City Council <br />with regard to the Project, have together served as an adequate and appropriate <br />evidentiary basis for the findings and actions set forth in this Resolution. <br />2. As the decision-making body for the Project, the City Council has reviewed <br />and considered the Final EIR, the administrative record for the Project , and all Project <br />materials on file with the City and available for review at Office of the City Clerk, 1017 <br />Middlefield Road, Redwood City California. The City Council finds that the Final EIR has <br />been completed in compliance with CEQA and the State CEQA Guidelines. <br />3. The City Council finds that the Final EIR for the Project was presented to <br />the City Council, that the Final EIR was prepared, published, circulated, reviewed, and <br />completed in full compliance with state law and CEQA Guidelines, that there was <br />adequate public review of the Draft EIR, that it has considered all comments on the Draft <br />EIR and responses to comments, that the Final EIR adequately discusses all significant <br />environmental issues, and that the Final EIR reflects the independent judgment and <br />analysis of the City Council. The City Council further certifies that it has reviewed and <br />considered the information in the Final EIR. <br />4. The City Council finds that the information added in the Final EIR, and any <br />information subsequently presented to the Planning Commission or City Council, does <br />not constitute significant new information requiring recirculation, but rather that additional <br />information clarifies or amplifies an adequate EIR <br />ATTY/RESO.0124/CC RESO RECOMMENDING CEQA CERTIFICATION —YMCA RESO.
