DES:djk ~9/28/95 (014/39) <br /> <br />permit is in effect, City may request Permittee to relocate its <br />construction equipment or other movable property placed by <br />Permittee in, upon or over the Subject Premises for the purpose <br />of facilitating City's use of adjoining spaces or areas within <br />the general area described as the Subject Premises. In the event <br />City requests Permittee to so relocate its property, and <br />Permittee fails or refuses to do so, City may do so at <br />Permittee's cost and expense. In such event, City may relocate <br />said equipment or property to another area within the general <br />area designated as the Subject Premises. <br /> <br /> 4. IMPROVEMENTS. Permittee shall not make, nor cause to <br />be made, nor allow to be made, alterations or improvements to the <br />Subject Premises (including the installation of any fixture <br />affixed to the Subject Premises) without the prior written <br />consent of City's City Manager. All improvements or alterations <br />constructed or installed shall be removed and the Subject <br />Premises restored to substantially the same condition existing <br />prior to such construction or installation, upon the termination <br />hereof unless the prior written approval of City's City Manager <br />is secured allowing such improvements or alterations to remain in <br />place, in which case, title thereto shall vest in City. <br /> <br /> 5. SIGNS. Permittee shall not construct, place, nor erect <br /> any signs in, upon or over the Subject Premises without the prior <br /> written consent of City's City Manager. <br /> <br /> 6. WAIVER OF CLAIMS. City assumes no responsibility for <br /> the guarding and safekeeping of property, equipment, or <br /> improvements installed or constructed by Permittee upon, or used <br /> <br /> 3 <br /> <br /> <br />
