6.H. - Page 2 of 12 <br />consequence of the penalty for a violation being reduced from a misdemeanor to a civil administrative <br />violation, staff believes officers would no longer have a valid legal basis to seize the firearm as evidence. <br />However, as part of the process of issuing the administrative citation, the Police Department could help <br />ensure the firearm is safely stored going forward by issuing a free trigger lock to the owner, if needed. <br />Unlike the state ordinance regarding safe firearm storage, a violation of the City's ordinance does not <br />carry a ten-year prohibition from owning a firearm, nor would it result in the temporary or permanent <br />seizure of an otherwise lawfully possessed firearm, as discussed above. In a review of other similar <br />ordinances in California counties and municipalities, staff was unable to find any examples where the 10 - <br />year prohibition against firearm ownership carried in the state law was enacted in a local ordinance. One <br />possibility the City Council could consider is further amending the ordinance to allow an owner found in <br />violation to surrender the firearm for destruction in lieu of paying the fine. Many commonly owned <br />firearms have value of less than $1,000, so allowing this alternative to a fine would provide an option that <br />could be more economically feasible for the violator and also permanently remove the previously unsafely <br />stored firearm from circulation. <br />FISCAL IMPACT <br />There is no direct fiscal impact to adopting the proposed ordinance. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting <br />ALTERNATIVES <br />The City Council may provide additional feedback prior to adoption or may elect not to adopt the <br />ordinance. <br />ATTACHMENTS <br />Attachment A - Proposed ordinance adding Chapter 37 to the Redwood City Municipal Code <br />Page 2 of 3 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.ore <br />232 <br />
