8. Contractor is responsible for any and all repairs required and called out in State inspections. If <br />the Contractor does not make the repairs by the deadlines given by the State, the Contractor <br />shall pay for any late fees issued by the State. This Paragraph C.9 notwithstanding, Contractor <br />shall not be liable for any such late fees if City has not furnished Contractor with the State <br />inspection notices (Preliminary Orders) in a prompt manner and allowing Contractor a <br />reasonably sufficient amount of time to perform the work prior to expiration of the deadlines. <br />9. Contractor will perform any work not specifically mentioned above, but which is needed to <br />make the maintenance complete within the intent of this specification, shall be performed <br />without additional cost to the City. <br />10. Under the Preventative Maintenance Requirements, Contractor shall not be required to: <br />a. Refinish, repair, and/or replace elevator car enclosures, hoist way enclosures hoist <br />way door panels, frames and sills, and lamps inside the cars, unless the foregoing are <br />damaged by negligence or misuse by any person or persons employed by or <br />representing the Contractor. <br />b. Repair or replace parts damaged by vandalism or negligence. <br />c. Repair or replace hydraulic cylinders and associated unexposed piping. <br />d. Repair or replace mainline and auxiliary disconnect switches, fuses, and feeders to <br />control panels. <br />e. Make changes or adjustments required by new or retroactive code changes. <br />f Make renewals or repairs necessitated by fluctuations in the building AC power <br />systems exceeding +/- ten percent (10%) variation, extreme variations in the machine <br />room temperature, or tampering with the elevator equipment by unauthorized <br />personnel. <br />D. Testing of Safety Devices <br />1. The Contractor shall periodically examine both car and counterweight. The first examination <br />shall be within one (1) month of the Effective Date of this Agreement. <br />2. On an annual basis, Contractor shall test the pressure relief valve of the hydraulic elevators. <br />The first test shall be done within one (1) month of the Effective Date of this Agreement. <br />3. For all elevators with firefighters' service, Contractor shall provide monthly Phase I recall <br />and a minimum of one -floor operation on Phase II to assure the system is maintained in proper <br />operating order. A written record of dates that tests were performed and findings on the <br />operation shall be made and kept in the machine room of premises. <br />4. Contractor shall test any battery lowering device annually and shall ensure that such devices <br />operate as intended. The first test shall be done within one (1) month of the Effective Date of <br />this Agreement. <br />5. Contractor shall test the operation of the elevator under fire and other emergency conditions <br />to determine conformance with the applicable requirements of Rules 211. 3 through 211. 8, <br />3128, Rule 1002.20. <br />E. Stock of Materials <br />Contractor shall provide only genuine parts supplied by the original manufacturer of the equipment <br />for replacement or repair, and shall furnish and use only those lubricants obtained from and/or <br />REV: 11-27-19 EI V <br />
