Business licensing: fees: exemptions: veterans. <br />Existing law provides that every person who is honorably discharged or <br />honorably relieved from the military, naval, or air service of the United <br />States and is a resident of this state is entitled to obtain a license to distribute <br />circulars and sell any goods, except alcohol, without payment of any state <br />or local business license fees. <br />This bill would also exempt a veteran who is honorably discharged or <br />honorably relieved from the Armed Forces of the United States and is a <br />resident of this state from paying any local business license fees for a <br />business that sells or provides services if the veteran is the sole proprietor <br />of the business. <br />This bill would include findings that the changes proposed by this bill <br />address a matter of statewide concern rather than a municipal affair and, <br />therefore, apply to all cities, including charter cities. <br />The people of the State of California do enact as follows: <br />SECTION 1. Section 16001.8 is added to the Business and Professions <br />Code, to read: <br />16001.8. (a) A veteran who is honorably discharged or honorably <br />relieved from the Armed Forces of the United States and is a resident of <br />this state shall not be required to pay any local business license fees for a <br />business selling or providing services if the veteran is the sole proprietor of <br />the business. <br />(b) The Legislature finds and declares that the prohibition on the <br />imposition of local business license fees on veterans as specified in this <br />section is a matter of statewide concern and is not a municipal affair, as that <br />term is used in Section 5 of Article XI of the California Constitution. <br />Therefore, this section applies to all cities, including charter cities. <br />U <br />95 <br />161 <br />
