6.D. - Page 3 of 50 <br />FISCAL IMPACT <br />The original ELS Professional Design Agreement, for design development and construction drawings, was <br />for a total of $5,118,639. Amendment No. 1 for Construction Administration Services is for $3,228,022, <br />bringing the total to $8,347,661. The City Council has allocated a total of $15.0 million towards the Project, <br />with $14.0 million funded from Park Impact Fees (development fees), and $1.0 million from the Stanford <br />University Development Agreement with the City. To date, between the original ELS Professional Design <br />Agreement and the Project Management services provided by Gilbane Building Company, there is a total <br />of $6,965,317 remaining. The total Phase 1 Project estimates needed for bond financing is approximately <br />$67.0 million and staff will return to the City Council later this spring with a bond issuance <br />recommendation. <br />ENVIRONMENTAL REVIEW <br />The proposed contract amendment for construction administration services is not a project under <br />California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because it has <br />no potential for resulting in either a direct or reasonably foreseeable indirect physical change in the <br />environment. On December 16, 2019, the City Council adopted a resolution certifying an EIR, adopting <br />CEQA findings, approving a Mitigation Monitoring Reporting Program, and adopting a Statement of <br />Overriding Considerations for the underlying project. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to approve Amendment No. 1 and to direct staff to develop other <br />alternatives for construction administration services and bring those back to the City Council at a future <br />date.
