<br />7C <br />Page 8 <br /> <br />with the Commission regarding the addition of positions; other personnel decisions are <br />discussed on an as-needed basis. <br /> <br />Despite its significant growth in tonnage and revenue, as well as the ever increasing <br />complexity of laws and regulations, the Port has added only one position in more than 10 <br />years and now has a total of 10 full time positions. These positions, authorized by <br />ordinance of the Commission, include the Port's executive director, managers of <br />operations and economic development, assistant manager of operations (in charge of <br />security), director of finance and administration, staff accountant, executive assistant, <br />receptionist/administrative assistant, and two maintenance personnel. <br /> <br />12. Has the port ever exercised its eminent domain power under Section 47f(16) and if <br />so, for what purpose? <br /> <br />A: The Port Commission views the use of its power of Eminent Domain as a very last <br />resource. The authority to use Eminent Domain must be exercised for Port purposes and <br />harbor development or in furtherance of any other powers granted to the Board of Port <br />Commissioners. The Port has no record of ever having used the power of Eminent <br />Domain. <br /> <br />13. What is the compensation paid to the city attorney under Section 47f(I7)? <br /> <br />A: Pursuant to a written agreement entered into in the year 2001 with the Port and the City <br />Attorney's Office, most legal services are rendered at the rate of$175.00 per hour by <br />contract attorneys under the supervision of the City Attorney. The monthly payments <br />fluctuate based upon the amount of work requested by the Port. <br /> <br />14. Give examples ofthe kinds ofthings the port does under Section 47f(18). <br /> <br />A: This Section of the Charter has been viewed as a legal "catch all" which does not expand <br />the jurisdiction and powers of the Port. The powers granted by this Section are necessary <br />for the implementation of the powers enunciated in Section 47f(1) though (17) as <br />emphasized by the last words of the Section "gennane to the scope of is [its] powers, <br />purposes and duties." <br /> <br />15. Does the board have adequate membership to perform its charter duties? For <br />instance, the board has 5 members but has broad responsibilities throughout the <br />community. Would the port benefit by expanding its membership? Would the port <br />benefit by having an advisory committee reporting to the board? <br /> <br />A: A Port Commission consisting of five members, appointed by the City Council, has <br />proven adequate to carry out its responsibilities. All the cities in San Mateo County, <br />except Redwood City, have a five member council. The councils of these cities have a <br />much greater role in the governance of their respective communities than that of the Port <br />commission and generally work effectively on city and regional issues.
