<br />7C <br />Page 7 <br /> <br />may hereafter be placed within said "Port Area" by the City <br />Council of Redwood City. <br /> <br />Although Section 47f(4) has never been amended, the City Council and the Port <br />Commission have, from time to time, transferred by joint resolution control over certain <br />areas within the Port Area. For example, control of the Port Marina was transferred from <br />the City (Parks and Recreation) to the Port. Jurisdiction over Redwood Creek south of <br />the entrance to Docktown Marina and the former sewer treatment plant was relinquished <br />from the Port Area to the jurisdiction of the City. See attached map of the "Port Area <br />Jurisdiction" in response to Question # 28. <br /> <br />There are two types of control and jurisdiction exercised by the Port. One type of control <br />and jurisdiction is exercised by the Port in a proprietary capacity over the land it owns <br />referred to in Section 48 of the Charter as "Harbor Lands." The other type is in a <br />regulatory capacity over a more expansive area referred to as the Port Area. <br /> <br />The City, by and through its Board of Port Commissioners, owns land which can be <br />generally described as most of the land East of the Port Marina and North of Seaport <br />Blvd. The Port acts as a land owner for these Harbor Lands as a manager as to the <br />navigable waters along said land subject to the covenants and restriction imposed by the <br />State under the Trust Doctrine. See the attached map of the Port of Redwood City and its <br />facilities. <br /> <br />The Charter distinguishes between the land over which the Port has ownership, control, <br />and management and the larger area over which the Port acts in a governmental <br />regulatory capacity. As a practical matter, the Port limits its regulatory control to the <br />issuance of penn its under Section 49 and Section 49b of the Charter. A section 49 permit <br />approved by the Port Commission is required for projects involving harbor structures or <br />buildings within the "Port Area" for which the Port Commission considers the character, <br />nature, size, and location of the project. An example is the Section 49 permit which was <br />issued by the Port Commission for the Westpoint Marina project. <br /> <br />The Port also has regulatory control under Section 49b over street, sewer, and other <br />public improvements by the City in the Port Area. The Port has generally limited its <br />regulatory control to street and utility improvements along Seaport Boulevard. An <br />example is the pennit issued by the Port Commission for construction of the recycled <br />water system along Seaport Blvd. <br /> <br />11. Describe the role ofthe board in hiring and firing employees (other than the <br />executive director) under Section 47f(11). <br /> <br />A: The Commission periodically issues a salary ordinance which specifies each position and <br />its corresponding salary range. The Commission holds the Executive Director <br />responsible for maintaining job descriptions, establishing a salary within the range for <br />each position, and making hiring and firing decisions.
