6.). - Page 62 of 103 ATTACHMENT B <br />S. NEW MATERIAL; ACCEPTABLE <br />The unit(s) herein specified shall be constructed throughout of new parts and materials, which shall <br />have seen no service other than that necessary for factory tests, unless otherwise allowed in the <br />Bid Specification. Items purchased hereunder will be subject to final inspection and acceptance at <br />delivery destination as set forth in this Notice Inviting Sealed Bids. <br />9. STANDARD EQUIPMENT <br />Vehicle(s) proposed by the Bidder must be equipped with the manufacturer's equipment and <br />accessories which are included as standard in the advertised and published literature for that unit <br />(from the manufacturer). No such item shall be removed because it was not specified in this Notice <br />Inviting Bids. To promote fairness in competition, items offered as standard equipment by a <br />particular manufacturer, but not recognized as such by the industry, should be clearly noted in the <br />bid submission. An option to delete those items at an offered price, may be included with the bid <br />submission. <br />10. LOWEST RESPONSIBLE BIDDER <br />In order to promote the policy declared above, contracts will be awarded only to such Bidders as <br />are determined to meet the following qualifications of lowest responsible Bidder. <br />The award may be to the lowest responsible Bidder or other Bidder. In determining who the award <br />is to be made, the awarding authority may consider, in addition to the Submitted Bid received, the <br />experience of the Bidder for the particular service sought, the quality of work that the Bidder has <br />done, the quality of the product or materials provided by the Bidder, the ability of the Bidder to <br />complete the project in a timely manner, the safety compliance record of the Bidder, and the <br />insurance carried by the Bidder. <br />11. AWARD OF CONTRACT OR REJECTION OF BIDS <br />The City reserves the right to amend or reject any or all proposals and also to select, modify, or <br />reject any of the bid items as the City sees in its best interest. Whenever quantities of individual <br />items are involved the City reserves the right to make single awards or separate items in an <br />aggregate of several items to various vendors. <br />12. GUARANTEE <br />The Bidder warrants and guarantees that all equipment, materials, vehicles or supplies used or <br />furnished and all workmanship are of the type and quality specified herein. The Bidder further <br />guarantees that any latent fault in construction or defective material discovered within one year <br />after acceptance of the work shall be remedied by Bidder without cost to the City, upon written <br />notice given to Bidder. Other subsequent latent defects shall be covered by responsibilities set <br />forth in the Iaw. In the event of failure to comply with the above-mentioned conditions within a <br />reasonable time after notice, the City will have the defects repaired and made good at the expense <br />of the Bidder; who agrees to pay the costs and charges therefore immediately upon demand. <br />51 Page <br />325 <br />
