GUIDING PRINCIPLES
The City should consider acquiring properties if:
• There is a demonstrated immediate public need
• There is a master plan for the expansion of specific City services and facilities
• The future land use is compatible with the General Plan, the City's Precise Plans
and the City Council's Strategic Initiatives
• The acquisition assists in assembling properties to promote City goals such as
development of affordable housing or parkland or will become part of a portfolio
of properties to lease for long-term revenue purposes
B. PURCHASE
The following guidelines apply to the purchase or rental of real property interests, whether in
the form of fee title, leasehold interests, rights-of-way or easements; and whether leased or
purchased with City funds or acquired via grants, donations, gifts, dedications via the
development review process or property exchanges.
1. Acquisition with City Funds.
The City Council should engage first in determining strategic objectives
relating to property acquisition such as increasing park space or
affordable housing stock. However, in some cases, opportunities may
present themselves and the City Manager may initiate work associated
with a potential acquisition consistent with the City Manager's
purchasing authority and consistent with the general guidelines below
including seeking City Council authorization to negotiate the acquisition
of any real property.
ATTY/POLICIES/PROPERTY ACQUISITION AND DISPOSITION PROCEDURES FINAL
REV: 09-16-13 PT
T
