6.C. - Page 28 of 29 <br />3. Right -of -Way. <br />Right-of-way (ROW) disposals may be initiated by the City or in response to public requests. <br />Right -of way will only be abandoned when it has no apparent City current or future use. The <br />following guidelines shall apply to the disposal of public ROW: <br />a) The City will follow requirements of the State of California Streets <br />and Highways Code in disposing and abandoning public right-of- <br />way. <br />b) Right-of-way that has been purchased in fee or easements <br />purchased with City funds will be sold or leased in accordance <br />with the policies above. <br />c) The City may reserve an easement for its water and sewer system <br />or may reserve a blanket easement for all utilities. Easements <br />used for utility transmission and distribution systems will normally <br />be reserved. If the utility previously using the easement declines <br />further use, the City will offer it to other utilities before <br />abandonment. <br />d) The City may place conditions of approval on abandonments of <br />right-of-way that must be satisfied prior to transfer of ownership <br />of the subject property or termination of the easement. <br />e) The City will not guarantee the title of any abandoned right-of- <br />way. Transfer of title to abandoned right-of-way that is owned in <br />fee by the City should be by a quit claim deed. <br />F. USE OF FUNDS FROM SALE OR LEASE <br />When the City sells or leases property, this revenue should be directed to certain funds and <br />purposes — housing, economic development, capital projects, and/or future land acquisition. <br />There is an on-going housing shortage occurring at all income levels and funds could be used to <br />develop the City's housing portfolio. Economic development funds may be supplemented to <br />support staffing for business outreach and development for programs such as the facade and <br />signage improvement programs, special events, and marketing.
