6.C. - Page 27 of 29 <br />1. Leases or Licenses with Non -Profit Organizations. <br />• Requests for the long-term use of City property by non-profit <br />organizations should generally follow the same review procedures as <br />the sale or lease of City property by private for-profit entities. <br />• The proposed use should not conflict with or preclude any existing or <br />planned future City use. <br />• Any development or operations directly related to the proposed use <br />should have a clear and measurable community benefit in alignment <br />with City goals, policies and plans. <br />• Any agreements for the lease of City property by non-profit <br />organizations at a below-market rate rent should include a provision <br />for community access and/or City use, or operate in close partnership <br />in the delivery of City services. <br />• Lessees will be responsible for all possessory interest and property <br />related use taxes that may be assessed. <br />• Lease agreements should include a waiver of any rights to relocation <br />benefits. <br />• Lessees must comply with non-discrimination requirements. <br />2. Interim Uses. <br />The Council will determine appropriate interim uses of City -owned property on a case-by-case <br />basis. The Council may wish to establish additional procedures by ordinance or resolution so <br />that interim uses may be authorized by the City Manager or the Community Development <br />Director. Lessees/licensees will pay comparable market rents, provided, however, below- <br />market rates may be considered for non-profit organizations in accordance with the guidelines <br />above. <br />• Unless otherwise agreed upon, lessees/licensees will be responsible for making <br />any tenant improvements, if any, and complying with all City zoning and land use <br />requirements, including any special conditions the City may place on the <br />property or particular noticing requirements that the City may enact. <br />• Environmental analysis is still required for interim uses. <br />ATTY/POLICIES/PROPERTY ACQUISITION AND DISPOSITION PROCEDURES FINAL <br />REV: 09-16-13 PT <br />Page 21 of 22 <br />51 <br />
