6.3C <br /> __ Page 1 <br /> REPC3RT <br /> To the Honorabie Mayor and City Council <br /> From the Cit 11f�ana er <br /> February 25, 2008 <br /> SUBJECT <br /> Summary Vacation of Easements for the Costco Project <br /> RECOMMENDATION <br /> Summarily vacate, by resolution, ce�tain streets and easemenfis over the lands of Price <br /> Company, a Delaware Corporation ("Costco"}, pursuant to Articie 8330 of the state <br /> Streets and Highways Code, to accommodate the proposed reconstruction of Costco. <br /> Easements, as identified on the attached �xhibit, are as folfow. (See Attachments 1 and <br /> 2). <br /> 1. One 1 Q foot wide Storm Drainage Easement; <br /> 2. One 15 foot wide Water Line Easement; <br /> 3. One 36 foot wide Utility Easement; <br /> 4. One 9 foot wide Sanitary Sewer Easement <br /> 5. One 5 foot wide Wire Clearance Easement <br /> 6. Qne Emergency Access, and Ingress/Egress Easement; <br /> 7. One former street easement; <br /> 8. A portion of the street along Middlefield Road, whife retaining a Public Service <br /> Easement. <br /> BACKGROUND <br /> in June of 2007, Costco obtained ar� Environmental Clearance, a Use Permit, and <br /> Architectural Permit for the reconstruction of its 160,000 square foot retail store at 2304 <br /> Middlefieid Road. The project requires the removaf of the existing warehouse-style <br /> s#are and construction of a new store on the opposite side ofi the site. Staff proposes <br /> vacating some existing easements and accepting other corresponding, relocated <br /> easements to accommodate the proposed project for the foflowing reasons. <br /> • Certain existing utilities have to be relocated to accommodate the new construction. <br /> These utilities include publicly maintained water lines and storm drains. <br /> • Some sections of Middlefield Road will require widening to accammodate <br /> construction af sidewalks along the frontage of the Costco property. <br /> • The reconfigured driveway entrance to the new s#ore requires an Emergency <br /> Access, and Ingress/Egress Easement. <br /> Prior to 1987, the Price Club recorded several deeds for easements which provided the <br /> City access to the property required for the original Costco develapment. These <br /> easements included access provisions for Street Purposes, and utilities {water, sewer, <br /> and storm drain). As well, Costco deeded emergency access easements to the City to <br /> accommodate the existing facility's entrance. The proposed rebuilding of Costco <br /> requires relocating utilities and the facility's entrance. Middlefieid Raad requires <br /> widening to accommodate a landscape strip and sidewalks. The existing entrance, <br /> pipelines, right of way, and appurtenances will be removed and replaced to <br /> accommodate #he proposed rebuilding of the facility. <br />
