6.3C <br /> On February 19, 2008, �he Pfanning Commissian considered the proposed vacations af Page 2 <br /> Iter� Nos. 7 and 8, idenfiified in the recommendaiian abov�, and found the praposed <br /> vacations are consistent with the General Plar�. <br /> In accorc(ance with the requirements of California Streets and Highways Code Sectian <br /> $92, the City Cauncil rnust determine whether the rights-of-way ar parts thereof for Item <br /> Nos. 6, 7, and 8 are not useful as a non-matorized transportation facility. A <br /> nonmotorized transportation fiacili#y means a facifity designed primarily for the use of <br /> pedestrians bicyclists, ar equesfrians. It may be designed primarily for one ar more of <br /> those uses. Staff beiieves fihat this finding can be suppnrted by the facts pertaining ta <br /> ltem Nos, 6, 7, and 8. <br /> Item No. 6 is an emergency access easement and pubiic ingress and egress easement. <br /> These easements are currently located within the Costco parking lat and as such are <br /> not useful as a nan-motorized tra�►sportation faciiity. ltem No. 7 is a remnant easem�nt <br /> that is located in what was formerly an �xfiension of Wilfaw St��eet. This rernnant <br /> easem�nt is currently bcated within Cnstco's parking lat; therefore, it cannot be used as <br /> a nor�-moforized transpartatior� facifity. Item No. 8 is currently used as part �f fhe main <br /> entrance to the exis�ing Castca parking Iot. As part of Costco's expansion plans, th�ir <br /> site design pEans ta discontinue the use af thES portian of the street as their m�ir� <br /> dri�eway entrance. This porfiion afi the street will be cios�d to stree� traffic and be <br /> utilized as a p�rking iot, as such, the partion of the sfireet to be vacated is not usefu{ as <br /> a norr-motorized transpartation facility. <br /> A companion staff report proposing the City accept easements offered by Costco to <br /> replace those vacated folfows this request to vacate. The vacated easements will be <br /> superseded by new easements to accommodate Costco's project. Please see attached <br /> map which shows the general location and shape of the existing easements ta be <br /> vacated. Legal descriptions and deeds are availabfe for viewing in the City Clerk's <br /> office.
