07/13/2020 <br />without limitation the Purchase Agreement, the City Charter, the General Plan, <br />Municipal Code, and other applicable City laws and regulations, have together served <br />as an adequate and appropriate evidentiary basis for the findings and actions set forth <br />in this Resolution. <br />Section 2. The City Council finds that the acquisition of the Property as <br />described in the Purchase Agreement is consistent with the objectives, policies, general <br />land uses, and programs specified in the City of Redwood City General Plan. <br />Section 3. The City Council determines based on the evidence in the record <br />that the fair market value of the Property is $4,391,000. <br />Section 4. CEQA. This activity is not a project under California Environmental <br />Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because the <br />intended use and future improvements on the subject site have not been identified and <br />thus the City cannot make a determination that the action would cause either a direct or <br />reasonably foreseeable physical change in the environment. This activity is also exempt <br />under section 15061(b)(3) because it has no potential for causing a significant effect on <br />the environment. A CEQA analysis would be required at the time a specific use and <br />improvements are identified and submitted for discretionary review. <br />Section 5. The City Council approves and authorizes the City Manager or her <br />designee, to execute and enter into the Agreement of Purchase and Sale and Initial <br />Escrow Instructions," between the City of Redwood City and the State of California <br />attached hereto as Exhibit A, with such minor conforming, technical or clarifying <br />changes or revisions as may be agreed to and approved by the City Attorney, which do <br />not materially increase the obligations of the City thereunder. The City Manager or her <br />designee and the City Clerk are further authorized and directed to take such further <br />actions and execute such documents on behalf of the City as are necessary to carry out <br />the transaction contemplated by the Purchase Agreement on behalf of the City, <br />including without limitation, a Certificate of Acceptance. <br />Section 6.
