Recently the cities of Burlingame and San Carlos reopened their streets because of increased patron activity and lack of adherence to County health orders regarding social distancing and use of masks. In Downtown Redwood City there have been a few recurring issues regarding enforcement of social distancing, use of masks by patrons in bars, excessive noise and crowds primarily at bars and businesses that serve liquor and are open until 1:00 a.m. City staff have responded to complaints regarding noise and occasional crowding. On August 4, 2020, the San Mateo County Board of Supervisors adopted an urgency ordinance establishing fines for individuals and commercial businesses who violate health orders. Commercial entities risk a minimum fine of $250 and a maximum of $3,000 per violation depending on the gravity of the health risk, prior warnings and any good faith efforts to comply. City staff is currently developing a formal process for addressing businesses that have had repeated complaints and warnings; the process will align with the County's Ordinance. FISCAL IMPACT The estimated cost for extending the temporary outdoor business program to January 31, 2021 is $125,000. ENVIRONMENTAL REVIEW This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably foreseeable indirect physical change in the environment. Similarly, the proposed activity falls within the scope of CEQA Guidelines Section 15061(b)(3), in that it can be seen with certainty that there is no possibility that the activity in question, namely outdoor dining on public and private property, will have a significant effect on the environment. Separately and independently, even if the activity constituted a project under CEQA, it would be exempt as set forth in CEQA Guidelines Section 15304, because the use of existing streets, sidewalks and private property for outdoor dining constitutes a minor temporary use of land having negligible or no permanent effects on the environment.
