6.B. - Page 2 of 7 The original contract issued in 2019 was based on staff's best estimate of earth disturbing activities before the construction started. The actual site excavation and grading schedule has proved to be more complex, expansive, and prolonged than expected. This amendment is necessary to perform all air sampling work to monitor the earth disturbing activities. Approximately 100 working days of monitoring is added to the original SCA's scope of work to adequately cover the remaining on-going earth disturbing activities at the site. Staff continues to work with Anderson Pacific, the general contractor performing the California Tank construction, to reduce the number of construction days that involve earth disturbing construction activities. FISCAL IMPACT Funds for this project were appropriated under the Fiscal Year 2019-2020 Water Fund Capital Projects - California Tank, Pump Station, and Generator. The project account has an available balance of $898,486.44 as of June 30, 2020. No additional funds are required. ENVIRONMENTAL REVIEW This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably foreseeable indirect physical change in the environment. On May 8, 2017, the City Council certified an Environmental Impact Report for the California Water Tank, Pump Station and Transmission Main Project. PUBLIC NOTICE Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting ALTERNATIVES The City Council may choose not to approve the amendment, however, this would be contrary to previous City Council action. Fence line perimeter monitoring is required by the Bay Area Air Quality Control Board for this project. The project construction will have to be stopped if monitoring would not be provided. Stopping the unfinished construction at this time will have significant negative impacts to the environment at and around the site, the potable water system services, and the construction contract.
