6.C. - Page 2 of 25 of the property owner, the City must complete inspections of every stormwater treatment device in the City at least once every five years in order to verify that proper maintenance is occurring. The Stormwater Treatment Measures Maintenance Agreement (STMMA) describes the maintenance and reporting responsibilities of the property owner, and allows for City staff to access the property in order to inspect the treatment measures. The project included the installation of frontage improvements on East Bayshore Road, including the installation of a catch basin which collects stormwater from the roadway. Once collected in this catch basin, the stormwater is routed through the subject property within a pipe and discharges to an existing storm drain system exiting the rear of the property. A license agreement will allow for the conveyance of stormwater collected on public property to cross the private property, and will require that the City be notified in advance if the method of conveyance is proposed to be changed. The site improvements were completed in 2015 and the STMMA and license agreement were prepared at that time. The signed license agreement was provided in July 2020. FISCAL IMPACT There is no fiscal impact to the City as a result of this action. ENVIRONMENTAL REVIEW This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably foreseeable indirect physical change in the environment. PUBLIC NOTICE Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting ALTERNATIVES The City Council may choose not to approve the Stormwater Treatment Measures Maintenance Agreement, however this would diminish the authority of City to access the property, and the City's ability to comply with the Municipal Regional Permit. The City Council may choose not to approve the License Agreement, which would limit the City's ability to assure that the path of travel for stormwater runoff is not blocked by any future changes to the site.
