6.H. - Page 6 of 11 <br />Upon the adoption of a resolution by the Council designating a commercial permit parking area, <br />the City Manager shall order appropriate signs to be erected in such area, indicating prominently <br />thereon the time limitation, day or days and hours during which parking shall be restricted. Parking <br />restrictions established pursuant to this Division shall be in effect between the hours of seven <br />o'clock (7:00) A.M. and six o'clock (6:00) P.M. from Monday through Friday with holidays specified <br />in Section 20.1 of this Chapter excluded, unless otherwise established by resolution setting <br />different parking restrictions for a particular commercial permit parking area. Such resolution shall <br />also state the requirements for obtaining a commercial parking permit. <br />Sec. 20.239. -VIOLATIONS: <br />A. It is unlawful and a violation of this Division, unless expressly provided to the contrary <br />herein, for any person to park a motor vehicle or commercial vehicle on a street in a commercial <br />permit parking area beyond the parking time limit, posted by signs giving notice thereof and <br />erected pursuant to this Division, without a valid commercial parking permit sticker properly affixed <br />to such vehicle. <br />B. No person shall park a motor vehicle or commercial vehicle within a commercial <br />permit parking area with a commercial parking permit sticker affixed to such vehicle evidencing <br />that such permit has expired or which has been terminated or is not valid for the area in which <br />such vehicle has been parked beyond the parking time limit posted by signs giving notice thereof <br />and erected pursuant to this Division. <br />C. It is unlawful and a violation of this Division for a person falsely to represent himself <br />or herself as eligible for a commercial parking permit or to furnish false information in an <br />application for any such permits. <br />D. It is unlawful and a violation of this Division for any person to use or display, or <br />permit the use or display of, a commercial parking permit sticker pertaining thereto on a motor <br />vehicle or commercial vehicle other than that vehicle for which such permit sticker was issued. <br />Sec. 20.240. - EXEMPTIONS: <br />A. Any motor vehicle or commercial vehicle on which is displayed a valid commercial <br />parking permit sticker pertaining thereto as provided for herein may be parked on a street in the <br />commercial permit parking area pertaining thereto without limitation of the time restrictions <br />established by the Council under Section 20.238. Such parking permit shall not guarantee or <br />reserve the holder thereof an on -street parking space on a street in such commercial permit <br />parking area. All vehicles issued a commercial parking permit are subject to all other parking <br />restrictions and regulations of the California Vehicle Code and this Code. <br />B. This Division does not apply to ambulances, fire department vehicles, police <br />vehicles, public utility vehicles or other official or emergency vehicles which have an official seal <br />or logo identifying them as such. <br />C. Commercial vehicles parked for the purpose of loading or delivery of goods, wares <br />or merchandise from or to any building or structure in a commercial permit parking area or <br />delivering materials to be used for construction purposes, including but not limited to repair, <br />alteration, remodeling, construction or reconstruction of any such building or structure for which <br />a building permit has previously been obtained shall be exempt from the time restrictions <br />ATTY/ORD.526/CC PROPOSED ORD ESTABLISHING CHAPTER 20—ARTICLE VII —DIVISION 16 (COMMERCIAL PERMIT PARKING) <br />REV: 10-07-2020 VR <br />Page 3 of 4 <br />165 <br />
