6.D. - Page 2 of 33 <br />ANALYSIS <br />Due to the limited sidewalk width, the two existing driveway approaches do not provide an accessible <br />path of travel across the property frontage. As a part of the project, the developer reconstructed the two <br />driveway approaches and provided an accessible path of travel. The accessible path of travel is at the back <br />of the driveway approaches and is within the 536 Whipple Avenue property in order to maintain the same <br />curb and gutter alignment. The developer granted access rights to the City for each driveway approach by <br />executing two Public Access Easements. The purpose of the easements are to allow the general public to <br />use this accessible path of travel. <br />The developer is also responsible for the maintenance of the on-site stormwater treatment measures that <br />will treat the runoff from the development prior to discharging to the City storm drainage system. These <br />measures protect the quality of water draining to San Francisco Bay and are required under the Municipal <br />Regional Stormwater Permit (MRP), adopted by the Water Board in November 2015. To document the <br />maintenance responsibility, the developer has executed a stormwater treatment measures maintenance <br />agreement (STMMA). <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />This action does not constitute a project as defined by the California Environmental Quality Act (CEQA) as <br />the acceptance and execution of the proposed agreement and easements will not result in a direct or <br />reasonably foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to approve the Stormwater Treatment Measures Maintenance <br />Agreement or Public Access Easement and direct staff to come up with alternate approach, however, that <br />would be contrary to the intent of both parties. <br />Page 2 of 3 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.ore <br />.A <br />
