10/26/2020 <br />burdens on the City and its residents and the impact on the environment and natural <br />resources that would be expected to occur from periodic flooding and inundation of an <br />existing commercial office center in the absence of the Levee Improvements; and <br />WHEREAS, there is no reasonable possibility that the approval and <br />implementation of the Levee Agreement, including the Seaport Levee -Related Actions, <br />will result in significant environmental effects due to unusual circumstances; and <br />WHEREAS, the City has received and reviewed public comments regarding the <br />Levee Agreement and the Seaport Levee -Related Actions; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES RESOLVE AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2. In making its findings, the City Council relied upon and hereby incorporates <br />by reference all correspondence, staff reports, and other related materials. <br />3. The approval and implementation of the Levee Agreement, which will result <br />in the Seaport Levee -Related Actions, is categorically exempt from the requirements of <br />CEQA because it falls within each of the classes of projects that the Secretary for <br />Resources has found do not have a significant effect on the environment pursuant to <br />Sections 15301, 15302, 15304, and 15311 of the State CEQA Guidelines, 14 CCR §§ <br />15000, et seq, entitled Existing Facilities, Replacement or Reconstruction, Minor <br />Alterations to Land, and Accessory Structures, respectively. <br />4. There is no applicable exception to the foregoing categorical exemptions. <br />None of the exceptions listed in Section 15300.2(a) -(f) of the CEQA Guidelines, entitled <br />Location, Cumulative Impact, Significant Effect, Scenic Highways, Hazardous Waste <br />Sites, and Historical Resources respectively, applies to the Seaport Levee -Related <br />Actions. <br />5. The City Council hereby directs the City Manager to file a Notice of <br />ATTY/RESO.0120fCC RESO APPROVING MASTER LEVEE AGREEMENT RESO. NO. 15900 <br />REV: 10-21-2020 VR MUFF NO. 506 <br />Page 5 of 7 <br />
