10/26/2020 <br />Exemption with respect to approval and implementation of the Levee Agreement, <br />including the Seaport Levee -Related Actions. <br />6. The City Council finds that the Seaport Levee -Related Actions, in particular <br />City's acquisition of the Levee Improvements pursuant to the Purchase Contract, are <br />consistent with the objectives, policies, general land uses, and programs specified in the <br />City of Redwood City's General Plan because this project will promote the public health, <br />safety, and welfare. More specifically, Safety Element Policy PS -7.5 calls for consultation <br />with public agencies responsible for flood protection, including FEMA, the U.S. Army <br />Corps of Engineers, and the California Department of Water Resources, in order to <br />maintain current flood hazard and floodplain information. This information is then used <br />as a basis for project review of flood protection systems such as levees, and to guide <br />development in accordance with federal, State and local standards. Also, Policy PS -9.1 <br />calls for seismic safety upgrades of public facilities and infrastructure, including levees. <br />Finally, Program PS -49 (Levees Upgraded to FEMA Standards) states, "Upgrade existing <br />levees in accordance with FEMA standards and FEMA direction to protect residential and <br />commercial areas against 100 -year flood hazards and sea level rise." The Seaport Levee - <br />Related Actions will directly implement Program PS -49 by upgrading the levee system in <br />accordance with FEMA standards, and will advance Policies PS -7.5 and PS -9.1 through <br />the repair, replacement and reconstruction of the subject levee protection systems while <br />following all applicable federal, State and local requirements. <br />7. The City Council hereby approves and authorizes the City Manager or her <br />designee, to execute and enter into the Levee Agreement in the form attached to the staff <br />report, subject to approval of the City Attorney, with such further minor conforming, <br />technical or clarifying changes or revisions as may be agreed to and approved by the City <br />Attorney, which do not materially increase the obligations of the City thereunder. The City <br />Manager or her designee and the City Clerk are further authorized and directed to take <br />such further actions and execute such documents on behalf of the City as are necessary <br />to carry out the Seaport Levee -Related Actions contemplated by the Levee Agreement <br />on behalf of the City, including without limitation, execution of BCDC permit applications <br />as co -applicant where such applications involve property currently owned by City; <br />ATTY/RESO.0120/CC RESO APPROVING MASTER LEVEE AGREEMENT RESO.
