The Seaport Centre Maintenance District currently funds certain of the <br />Services related to Seaport Centre and has funded certain maintenance reserves (the <br />"Maintenance District Reserves") held by the City. <br />Consistent with the request of the owners of the parcels constituting Seaport Centre, the City <br />Council intends to provide for termination of the Seaport Centre Maintenance District in <br />connection with formation of the CFD and, after dissolution of the Seaport Centre Maintenance <br />District, to deposit the remaining funds in the Maintenance District Reserves into one or more <br />maintenance reserve funds to be established and held by the City as a result of forming the CFD. <br />Section 12. Public Hearing. Section 32.987 of the CFD Law authorizes any procedure <br />not expressly set forth in the CFD Law but deemed necessary or convenient by the City Council <br />to carry out any of the purposes of the CFD Law. The property owners in the CFD have petitioned <br />the City Council to hold the public hearing required by the CFD Law as soon as possible after the <br />adoption of this Resolution. The City Council hereby determines that it is necessary and <br />convenient for Monday, November 23, 2020, at 7:00 p.m. or as soon as possible thereafter, to be <br />appointed and fixed as the time and place when this Council, as legislative body for the CFD, will <br />conduct a public hearing on the establishment of the CFD and consider and finally determine <br />whether the public interest, convenience and necessity require the formation of the CFD and the <br />levy of the Special Tax. In accordance with Governor Newsom's Executive Order No. N-29-20, <br />the City Clerk is hereby directed to notify interested parties that they may participate in the public <br />hearing by teleconference. <br />Section 13. Notice of Hearing. The Clerk is hereby directed to cause notice of the <br />public hearing to be given by publication one time in a newspaper published in the area of the <br />CFD. The publication shall be completed at least seven days before the date of the public hearing <br />specified above. The notice shall be substantially in the form specified in Section 53322 of the <br />Act, with the form summarizing the provisions hereof hereby specifically approved. <br />Section 14. California Environmental Quality Act. The City Council hereby adopts and <br />incorporates by reference as though fully set forth herein its findings related to the Facilities in <br />Resolution No. 15900 adopted on October 26, 2020, for purposes of complying with the <br />California Environmental Quality Act (California Public Resources Code, Section 21000 et seq.). <br />Section 15. No Obligation. This Resolution shall in no way obligate the City Council to <br />form the CFD. The formation of the CFD shall be subject to the approval of this City Council by <br />resolution following the holding of the public hearing referred to above. <br />Section 16. Effectiveness.
