The Honorable Mayor Diane Howard/City Council <br />Page 2 <br />August 7, 2020 <br />the proposed lease, it would be liable to the City for liquidated damages in the amount of <br />$2,000,000.00 under Section 18.9.3 of the propose lease agreement. <br />The land exchange agreement was calendared for consideration by the County at its July 7, <br />2020, Board of Supervisors meeting. The County's staff report recommended approval of the <br />agreement and related measure and stated that, upon acquisition of the City's 1402 Maple Street <br />project: <br />[A] planning exercise for the City Property will be initiated that will evaluate <br />potential County uses and programs to be located on the City Property, which <br />may include immediate shelter resources needed as part of the COVID-19 <br />response, a new permanent homeless shelter and associated services, <br />transitional housing, and affordable housing. <br />County Staff Report dated July 7, 2020 at page 2 ("County Staff Report"). <br />At the July 7 hearing, County staff indicated that the land exchange agreement needed to be <br />approved on an "urgent" basis so that the County could apply by July 25 for federal CARES <br />Act funds in support of providing homeless services. Supervisor Horsley stated that the County <br />had "looked for years" for an appropriate site for a homeless shelter, that the County had not <br />been able to find "any place in San Mateo County willing to host a homeless shelter" and that <br />the 1402 Maple Street site, the property the County would acquire in the land exchange, was <br />the "best and only site for this facility." Supervisor Groom concurred that the 1402 Maple Street <br />site was an "ideal piece of land" for the Maple Street Shelter or similar facility. The proposed <br />land exchange agreement was then unanimously approved by the County at the July 7 hearing. <br />The Project Addendum Fails to Analyze the Environmental Impacts of Relocating the Maple <br />Street Shelter <br />After the land exchange agreement was quickly approved by the County, the Project was <br />calendared for consideration by the City Council on July 13. At this meeting, in addition to <br />being asked to approve the proposed land exchange, the City Council was asked to adopt an <br />"Addendum to the 1548 Maple Street Project Environmental Report" for the Maple Street Land <br />Exchange Project dated July 2020 and prepared by LSA (the "Addendum").' According to the <br />City's July 13 Staff Report (the "City Staff Report"), the Addendum was prepared "to determine <br />whether and to what extent the [ 1548 Maple Street EIR] is sufficient for addressing the potential <br />impacts of, and providing required mitigation for, the Real Property Exchange Agreement <br />development activities." Staff Report at page 8. <br />The Addendum concludes that the Project "would not cause new significant environmental <br />effects not identified in the [1548 Maple Street EIR]" and that the Project would otherwise not <br />introduce any of the conditions requiring the preparation of a Supplemental EIR as set forth in <br />Section 15162 of the CEQA Guidelines. Addendum at page 1-1. The Addendum therefore also <br />' As you will recall, the 1548 Maple Street Project is being undertaken by Strada Investment Group, which proposes <br />the construction of 131 three-story for -sale condominiums. The City Council certified the 1548 Maple Street Project <br />Environmental Impact Report (the "1548 Maple Street EIR") on May 7, 2018. <br />
