resolution or other appropriate process and the applicant shall record public service and <br />public access easements over the vacated land. The applicant shall install the dog park <br />improvements within this space, including the large and small dog park areas separated <br />by a new public path connecting Chestnut and Main streets. The improvements shall <br />match existing and the applicant shall restore and repair all work impacted during the <br />expansion. The final design for this area shall be reviewed and approved by the Parks, <br />Recreation, and Community Services Director prior to acceptance by the City. The <br />Applicant shall be responsible for maintenance of the plaza in front of the expanded dog <br />park. <br />g. Entertainment Establishment totaling approximately 19,000 sq. ft. located on the ground <br />floor and fronting EI Camino Real between Beech and Cedar (Parcel B). This space shall be <br />occupied with a family-oriented entertainment use. <br />If the applicant is unable to secure a viable tenant, after demonstrating its efforts, the <br />City may allow the space to be used as a small format grocery store or other permitted <br />retail use that is deemed acceptable by City. This modification in use shall be reviewed <br />and authorized by the Community Development and Transportation Director and may <br />require circulation modifications at Beech Street and EI Camino Real, as determined by <br />the City Engineer. <br />Fees <br />The following fees must be paid in full prior to issuance of the building permit unless otherwise described <br />below. <br />8. Transportation Impact Fee - Pay a Traffic Impact Fee for the net new trips resulting from the <br />proposed project, estimated at $1,151,304. [SDR] [ENGINEERING] <br />9. Mitigation Improvement Fees - The project will be subject to additional fees as outlined in the <br />adopted Mitigation Monitoring and Reporting Plan and Local Transportation Analysis. [COA] <br />[ENGINEERING] <br />a. Transportation Fair Share Contributions <br />i. 101184 Interchange Project— pay a fair share contribution to mitigate impacts on the <br />101/84 interchange, estimated at $3,917,584 based on 1,957 employees and 1,485 <br />residents. This covers contributions for the following required mitigations: MI -1, MI - <br />3a, MI -3b, and MI -5. [ENGINEERING] <br />ii. Roosevelt Avenue Traffic Calming Project - pay a fair share contribution to the <br />Roosevelt Avenue Traffic Calming Project, estimated at $572,895 based on the project <br />contributing to an average of 22% of the cumulative growth on Roosevelt Avenue. <br />This was identified as the preferred mitigation improvement for this deficiency. (MI - <br />7) [ENGINEERING] <br />b. Emergency Water Storage Fair Share Contribution — Pay a fair share towards the <br />emergency potable water storage needs of the City as mitigation for the project.
