This City Council hereby determines that the Services are necessary to meet increased demands placed upon the City as the result of construction of the Facilities and of anticipated future development or redevelopment within the CFD. The Administrative Services Director (or designee) of the City of Redwood City, 1017 Middlefield Road, Redwood City, California (650) 780-7220, is the officer of the City who will be responsible for preparing annually a current roll of special tax levy obligations by assessor's parcel number and who will be responsible for estimating future special tax levies pursuant to the CFD Law. Section 10. Tax Lien. Upon recordation of a notice of special tax lien pursuant to Section 3114.5 of the Streets and Highways Code of California, a continuing lien to secure each levy of the Special Taxes shall attach to all nonexempt real property in the CFD and this lien shall continue in force and effect until the Special Taxes obligation is prepaid and permanently satisfied and the lien canceled in accordance with law or until collection of the Special Taxes by the City ceases. Section 11. Appropriations Limit. In accordance with the Act, the annual appropriations limit, as defined by subdivision (h) of Section 8 of Article XIII B of the California Constitution, is hereby preliminarily established at $25,000,000, and said appropriations limit shall be submitted to the voters of the CFD as hereafter provided. The proposition establishing said annual appropriations limit shall become effective if approved by the qualified electors voting thereon and shall be adjusted in accordance with the applicable provisions of the Act. Section 12. Election. Pursuant to the provisions of the CFD Law, the proposition of the levy of the Special Taxes and the proposition of the establishment of the appropriations limit specified above shall be submitted to the qualified electors of the CFD at an election. The time, place and conditions of the election shall be as specified by a separate resolution of the City Council. Section 13. Tender. This City Council reserves to itself the right and authority to allow any interested owner of property in the CFD, subject to the provisions of Section 53344.1 of the Act and as it may otherwise impose, and further subject to any applicable prepayment penalties prescribed in the documents governing issuance of any bonds of the City for the CFD, to tender to the City Manager (or designee) in full or partial payment of any installment of special taxes or the interest or penalties thereon which may be due or delinquent, but for which a bill has been received, any bond or other obligation secured thereby, in the manner described in Section 53344.1 of the Act. Section 14. California Environmental Quality Act. The City Council hereby adopts and incorporates by reference as though fully set forth herein its findings related to the Facilities in Resolution No. 15900 adopted on October 26, 2020, for purposes of complying with the California Environmental Quality Act (California Public Resources Code, Section 21000 et seq.).
